Capital Gain is charged under Income- tax Act. Sections 45 to 55A of Income Tax Act govern the levy of Capital Gain Tax. “Capital Gain” is purported to mean any profits or gains arising from the transfer of a capital asset effected in the previous year. “Capital Gain” shall be deemed to the income of the previous year in which the transfer takes place.
